Product Availability
Delivery dates are provided for information purposes only. Estimated delivery times are 14 to 30 days for above-ground pools, 14 to 30 days for patio furniture, 14 to 30 days for pavilions, 14 to 30 days for heat pumps, 3 to 7 days for pool accessories and small equipment, and 3 to 7 days for chemical products.
Payment Method/Billing
Payment by credit card is the only form of payment accepted for online purchases on the Site. Only VISA, MasterCard, and AMERICAN EXPRESS credit cards are accepted.
User Account
You may be required to create a user account and password in order to order products online. You are responsible for all use (including unauthorized use) of your account and for maintaining the confidentiality of your information. We assume no obligation to verify the identity of the person using your account, and you are entirely responsible for purchases made through it. We reserve the right to suspend or cancel your account, with or without cause, at any time and without notice.
Refusal or Cancellation of an Order
Receipt of an order confirmation email does not constitute acceptance of your order or an offer to sell a product.
We reserve the right, at our sole discretion and at any time, not to process, not to accept, or to cancel an order, including but not limited to where the desired product is out of stock, in the event of a pricing display error, or if important information about a product is missing or inaccurate on the Site. In addition, we reserve the right, without notice, to limit the quantity of any product per order or to refuse an order for any reason. If we do not process, refuse, or cancel an order as described above, we will notify you and you will not be charged, or if you have been charged, you will be refunded. Trévi Ste-Agathe disclaims all liability in the event of stock shortages, pricing errors, and for any damages that may result therefrom or be caused by delivery delays.
Delivery
The Company will use reasonable means to meet the indicated delivery date but shall not be held responsible for delivery delays attributable to causes beyond its control, including force majeure and weather conditions.
Deliveries will be made outside the building only.
Upon delivery, if an item or part is missing or damaged, the Buyer must contact Trévi Ste-Agathe by email at boutique@trevisteagathe.ca
within 10 days following receipt of the purchase to coordinate the exchange or delivery of the missing or damaged item.
Final Sale. No Refunds or Exchanges
All sales are final. No returns, exchanges, credits, or refunds.
ABOVE-GROUND POOLS, GARDEN PAVILIONS AND GAZEBOS
Pools, garden pavilions, gazebos, and accessories purchased through the Site ARE SOLD WITHOUT INSTALLATION. You are therefore solely responsible:
a) For the installation of the pool, garden pavilion, gazebo, and their accessories (if applicable). You are also solely responsible for all costs and expenses related to preparation, installation, and connection.
b) For selecting the location of the pool, garden pavilion, or gazebo. You must ensure that the chosen location complies with municipal and provincial regulations, including required setbacks from property lines and airspace above the location.
c) For notifying the relevant companies and authorities of the installation of the pool, garden pavilion, or gazebo, including electricity, water, sewer, gas, and telephone providers, as well as municipalities, agencies, and ministries, as applicable.

EXCEPT FOR MANUFACTURERS’ WARRANTIES FOR PRODUCTS OFFERED FOR SALE ON THE SITE AND LEGAL WARRANTIES PROVIDED BY LAW, TRÉVI STE-AGATHE MAKES NO REPRESENTATION OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PARTICULAR USE FOR WHICH A PRODUCT MAY BE INTENDED.
Indemnification
By using this Site, you agree to defend and indemnify Trévi Ste-Agathe, its directors, officers, and employees against any claim, action, demand, liability, expense (including legal fees), or damages (including direct, indirect, special, exemplary, punitive, and incidental damages) resulting from your use of the Site, your browsing or connection to it, or any other violation of these Conditions relating to the use of the Site.
General
These Conditions are governed exclusively by the laws of the Province of Québec, to the exclusion of all rules of private international law or conflict of laws, except where prohibited by law. Any dispute, claim, or action arising out of or in connection with these Conditions shall be submitted to the exclusive jurisdiction of the competent courts of the Province of Québec, except where prohibited by law.
These Conditions and the documents referred to herein constitute the entire agreement between Trévi Ste-Agathe and you regarding your use of the Site and purchases made on the Site. Any action taken by Trévi Ste-Agathe to insist on strict performance of any provision of this agreement, or failure to enforce it, shall not be construed as a waiver of any provision or right. If a court of competent jurisdiction determines that any provision of this agreement is null, invalid, or otherwise unenforceable, such determination shall not affect the remaining provisions of this agreement.
